Virginia AG Intervenes in GOP Ballot Dispute as Blocked Candidates Join Suit

Virginia Attorney General Ken Cuccinelli is intervening in his state’s presidential primary dispute and plans to file emergency legislation to address the inability of most Republican presidential candidates to get their name on the ballot, Fox News has learned.

Meanwhile, four GOP candidates on Saturday joined fellow candidate Rick Perry’s lawsuit against the state, urging the Board of Elections to either allow them on the ballot or at least refrain from taking any action until a Jan. 13 court hearing.

Only Mitt Romney and Ron Paul qualified for the Virginia primary, a contest with 49 delegates up for grabs. Perry and the four candidates joining the lawsuit — Newt Gingrich, Michele Bachmann, Rick Santorum and Jon Huntsman — did not.

    It seems that the Attoney General of Virginia is up for a good court battle. He can not deprive someone from being on the VA ballot just because he’s in Holder(man’s) and Obumo’s back pocket. I hope these candidates win the challenge in federal court. You have to be on the VA ballot to be president. You have to be on the ballot for all 50 states and VA is one of the states. Obumer didn’t qualify for most states’ ballots in 2008. He and Hitlery cheated if they couldn’t get on a ballot.       No, you don’t have to be on the ballots of all states to become president. Actually, if you are only on the ballots of the 12 most populous states and you win the primary in all of them, you will have enough electorial votes to win.

      Also, this is not a vote for the president. This is a vote for the republican candidate for president.

      As only two candidates took the time to obey the VA law and do what was needed to get on the ballot, it is pretty damn sorry of the others to use a lawsuit to get on the ballot without doing what VA law says you need to do. They didn’t take the time to know and follow the law so now they should shut up and leave it alone.

      After all, VA only has 7 delegates so its not like it is a really important state to win. It is sickening to watch these lazy fools try to get on the ballot the “easy” way after they could not get on the legal way.

        Newt, at least, had enough signatures on what was turned in. He was denied because of some questionable calls on whether or not those signatures passed scrutiny. He lives in Virginia after all. Do you really think he didn’t do what he thought was enough to make the ballot?

            I’m especially annoyed with those who only make their decision based on what they heard on the LSM. Lazy voters got us in the mess we’re in now.

          Obama, Ron Paul and Romney did not have their signatures scrutinized at all, because in VA if the signatures are turned in a certain amount before the deadline they are accepted as is. RP just passed his signature sheets around on college campuses, with the people collecting signatures telling everyone that RP would legalize drugs on day one. They are delusional.

            I just want to state some FACTS. The US had veriafiable info that Sadaam had or was close to obtaining weapons of mass destructions. Sadaam and his sons regularly stopped and picked up innocent girls on the street, raped them repeatedly, covered them with honey and put them in rooms filled with killer bees or threw them into one of his many arenas and opened the doors to starving killer dogs. If there needs to be a re-vet on the signatures, fine, but for the others to try and get on a ballot they didn’t even put the money or effort into getting the necessary signatures for, then stick it.

      The Attorney General of Virginia is not trying to keep them off the ballot, he is trying to HELP them get on the ballot. He agrees the ballot process needs revision. He believes that Virginians should have more opportunity to help in the nomination process for the Republican candidate for President.

        Thank you! Your read the entire article where I can see by some of the responses, it was too much trouble for them to read. Or maybe they can’t. At any rate the AG as well as reps from both parties are endeavoring to make their ballot process more equitable for their voters and not to unnecessarily limit Official Candidates ability to be represented on the ballot.

    Anyone who has followed AG Cuccinelli’s political statements and suit against Obamacare and still thinks he’s on Obama and Holder’s side of issues amazes me. Actually, some of the Republican candidates’ campaign teams, such as Gingrich, turned in 11,500 some petition names but many were eliminated for one technicality or another. I do believe the rules should be followed but also think, as a registered Republican, that if Virginia wants to have a place in the political competition, the rules should be relaxed for the Primary. They not only required 10,000 names, statewide, they require at least 400 in each Congressional District. If one district has a number of names disqualified by the reviewers, the name will not appear on the ballot. There have also been reports that write-ins are not permitted by the law. If true, that seems unnecessarily onerous also,

    Bachmann shut down her VA in October. If she was really serious about VA she wouldn’t have closed it down.
    I don’t even think Huntsman and Santorum had offices in VA.
    When vetting the signatures Newt and Perry got, they found some inavlid – and now those two are complaining!
    Mitt and Ron spent their campaign funds on getting the qualifying amount needed. Bachmann, Huntsman and Santorum didn’t.
    If the AG wins this lawsuit, then the GOP needs to reimburse Mitt, Ron, Newt and Perry for expenditure otherwise it’s not fair at all.
    I think this also goes to a candidates ability to garner support both financially and with the electorate and lead. If the candidates named in the lawsuit couldn’t even get on the ballot in one state, then how on earth can anyone expect them to be the leaders of our country?
    At least Virginia is now vetting signatures. How often do we complain, and I include myself here, that elections are rigged? I’m happy VA stepped up and looked to ensure the signatures were valid. As for those candidates too disorganized to even get signatures, I say tough.

        A lot of the registrars vetting those signatures are Democrats. Just as we saw in Florida in 2000, they will use any pretext to disqualify a signature or a vote for a Republican.

        Does this law suit have anything to do with Obama? And, if he does try to have Mickey Mouse sign a position, it seems the good people of Virginia have provided a way to have the little rat disqualified.

        We all seem to want to have fair elections; and, fair elections require laws. It is disappointing that even here, where we so often hear the cry for honest elections, people are now wanting to see their favorites get an extra bite at the apple. These candidates did not meet the requirements to be on the ballot and to change the law after the deadline passes means that the election will not be fair — no matter who wins.

    I love Cuccinelli but if we are a nation of laws, obey the election laws of the state. This is bad for the state when the AG is going to end run around the law for 2 lazy candidates that dont have their acts together. I keep hearing that Paul is crazy..well he followed the law, so he can’t be that crazy and he will be on the primary ballot because he and his supports did what was required.

      Bad laws need to be challenged…This is what’s happening here…The people of virginia should have the same options available to them as the rest of the nation,this is more important than the minutia surrounding it…..My parents are from virginia and left there in the fifties because it is one of the most backwards,dictatorial places you can imagine in some ways….It is an official “commonwealth”…..

        They do have the same chance anybody else has, Ned. They can vote for anybody who considered it important enough to meet the qualifications to be on their state’s primary ballot. Some candidates did not feel it that important. That they do now, shows a willingness to flount the law, not a good sign in a person who we will someday have to rely upon to uphold the law.

        This is a national election for the highest office in the land. EVERY voter in every state should have the opportunity to vote for anyone who is running, whether its the primary or the main election.

        Virginia’s rules are archaic to say the least. Hell, the Democrats in Illinois allow dead people to vote every single election, and refuse to take steps to clean out the corruption in our voting procedures. They are vehemently against any kind of voter proof of indentity, for example. That one thing alone would go a long way toward eliminating the corruption.

      This is great for the State of Virginia. Such laws make them look absolutely stupid. Voting is an American Right and any laws that restrict this right is illegal. No state should have such a law. If a Candidate qualifies for Federal Funds for their Campaign then this should be recognized in all States as qualifying for appearing on that states ballots.

        The law doesn’t restrict at all. You need to explain why you feel it discriminates.
        This law is the exact opposite of discrimination. Everyone had the chance to sign onto a candidate. Of course, some of the candidates decided Virginians weren’t important enough to get signatures from, and didn’t run campaigns in Virginia. That’s not the state’s fault, but the fault of the candidate who neglected the state.
        Don’t blame the state for lazy candidates.

    People,this is a primary election,and everybody that meets the constitutional requirements to run,should be on all 50 state ballots,I t should not be decided by some state qualifing goof up.Now if this was the presidential election,that would be differrent,anyway we can keep Obama off a ballot is a good thing.

    Changing the rules in the middle of the game is something I expect from Democrats. I am very disappointed in our Attorney General. The candidates should know the rules of the states and play by those rules. If they can’t do this, what kind of president would they make? These rules have existed for many years and many candidates have met the qualifications. Just because those who failed to get on the primary ballot, doesn’t mean they won’t be on the ballot for the presidency.

    It would be good that this law were reversed. It was passed by legislators wanting to curb any kind of competition they would have to get re-elected. And it is interesting that they would check the authenticity of those signing to get people on a ballot, check on the republicans, and not the democrats. Obama would not have even been on the ballot in one state this last election if they had checked. You wonder why these people go through so much to get elected. The answer is stuff like insider trading and getting rich from John Q Public.

      DH, I once headed up a petition drive to have two school districts consolidated; and, every petition was carefully scrutinized by a county judge and representative from the pro side and the anti side. If you don’t expect something as simple as this — would you also oppose a photo ID for voting?

    Look, these rules were known, or should have been, to the candidates from the outset. And, besides these are not simply rules — they are Virginia law; and, these candidates simply did not comply; and, now that the deadline has passed, they want the law changed.

    What kind of attitude is that for someone who wants to go to the White House and swear to uphold the Constitution — the Supreme Law of the land? What happens when the Constitution stands in their way of getting what they want? Think Obama, anybody?

    My questions for those who say that Virginia should not require as a minimum 10,00o signatures of LEGAL American citizens, and residents of the state, who also must have a pulse, be @least 18 yrs of age, and not a convicted felon. If any one or all of that is wrong, then what would you recommend? If 10,000 is wrong, then what should the number be, 1,000, and should the signatures be from every county or just from “within the state, period.”
    I supported and help elect Ken Cucinelli as our A.G. but, I have to wonder about his decision to intercede on behalf of those who did not follow the rules or failed to get enough signatures to overcome possible challenges and having some of the signatures thrown out as fraudulent.
    Has anyone else noticed that the only ones who did not follow the rules or made very bad decisions resulting in their being declared as ineligible, are either current or previous members of the congress (Michele Bachman, Rick Santorum, Newt Gingrich) or a three term governor of TX. (Rick Perry) or Governor of Utah, Ambassador to China and other posts, (J. Huntsman) what does that imply or signify to you. Could it possibly be that they are so used to “not following the rules or laws” because they considered themselves “special” they could do as they pleased and not suffer the consequences of their actions or exercising Bad decision making.
    They, above all others should have known the rules, and if they objected to all or any part of those rules they have had months if not years to have brought forth their objections. None of them did so. I have to ask, WHY didn’t they?
    If they are allowed to be on the republican ticket in the primary, then why have restrictions that would prevent others from getting on the ticket or ballot?
    The election laws or regulations in all or at least most states make it extremely hard if not impossible for anyone other than a republican or democrat to get on the ballot in any election., and is that way because both parties want to keep the power unto themselves and not let a third party be part of any election cycle. I say to hell with both parties and lets have completely open and free elections, but restricted to legal residents of the state who are property owners or taxpayers, and be able to prove it. I also think any one registered as an Independent should be allowed to vote in one of the primaries, whether it’s republican, democrat or something else…..and also be allowed to vote in the general election for anyone regardless of party affiliation. Key is, if you don’t own property, pay taxes (local, state and federal) or a legal American citizen, andare a registered voter, you cannot vote, period. That would eliminate most of the est. 30 to 45% living off other peoples money that is conficated by government.
    That alone, would probably correct all of our economic problems, and most of our social and foreign affairs issues as well, because the scam artisans would be voted out of office the very next election cycle.

    If these guys cant obey the rules now, what do you think theyll do as president. Just more of the same. No surprise.

    This is R.Perry’s first time in a presidential campaign. His crew certainly would not have had a reason to investigate Virginia’s law. The state people should have sent each candidate notification about this.

    At least the VA Attorney General is attempting to rectify whatever went wrong.

    The states who decided primaries in the first quarter of the year are ridiculous. The primaries should be made no earlier than July or August prefaced by a nationally televised two-hour progam where each candidate has 15 to 20 minutes to speak about his or her plans that would be put into place should he or she win the primary and then the Nov. election. No debates, no backbiting each other, nothing allowed except to explain what has to be corrected and how it should be corrected.

    Who’s for that suggestion, please?

    It is very simple if you do not have the correct number of qualifying signatures on your nominating petition you do not qualify to have your name on the ballot. They should not be allowed to correct their mistakes now, every state has a deadline for the petitions to be submitted in order to qualify as a candidate and be placed on the ballot.

      How did they qualify the signatures? Maybe they just crossed off every 10th name? I don’t know, however it seems very fishy to me. I also think that having to get people to sign a petition to get on the ballot is rather stupid. Also, if you’re a democrat then hitler & mickey mouse is legal. The whole system needs to be scrapped & started over.

    Ridiculous. If the candidates don’t follow the rules then we should change the rules after the fact? As a Virginian and conservative who votes let me assure you that is not a party I with which I wish to associate.

    Go ahead and change the rules Cucinelli but know in doing so you have lost my respect and future votes.

    My son and his fiancee re-registered from Dem. to Rep. when they voted in PA’s. recent local elections.
    The person who took their new registration forms was a Dem. and they feared that the forms would not get turned in.
    Last week they went to their courthouse to ask why they had not received their new voter registration cards.
    They were RIGHT. The ones they had filled out never got turned in. The courthouse had no record of their changing parties. They re-registered at the courthouse and got their new forms immediately.
